CyberFOX Referral Program - Terms of Service

These terms and conditions govern the CyberFOX Referral Program. By participating in this program, you agree to the following:

  1. Eligibility:
    1. You must be an Active Partner or an Approved Referrer of CyberFOX to be eligible for a referral award.
  2. Agreement to Terms:
    1. These Terms and Conditions (the “Terms”) govern your participation in the Program, and it is your responsibility to read and understand the Terms. By participating in the Program, you represent and warrant that
      1. You agree to and will comply with the Terms
      2. You are in compliance with, and will continue to comply with, any policies your employer may have regarding participation in this type of incentive program.
  3. Referral Requirements:
    1. A Referral Form must be fully completed and submitted to CyberFOX.
    2. The referred entity must not have previously been engaged by CyberFOX in any capacity.
    3. The referral must close within 12 months from the date of the referral submission. "Close" is defined as the referred entity signing an annual agreement for CyberFOX services.
    4. The referred entity must sign an annual agreement for CyberFOX services.
  4. Referral Award:
    1. The referral award will be equal to one full month's payment based on the referred client's initial agreement, with a maximum award of $5,000. For referred clients who pay annually, the referral award will be equivalent to one-twelfth (1/12) of the total annual payment.
    2. The Referral Award will be paid to the eligible referrer 30 days after CyberFOX receives the first full payment from the referred client.
  5. Modifications to Program:
    1. CyberFOX reserves the right to modify or terminate this Referral Program at any time without prior notice. Any changes will be posted on our website. For any questions regarding the Referral Program, please contact our Partner Program team.
  6. Program Integrity and Compliance:
    1. CyberFOX reserves the right to revoke the participation privileges of any person who engages in any fraudulent or harmful activity or uses the Program in a manner inconsistent with these Terms or any federal, state, or local laws, statutes, regulations, or ordinances. If your privileges are revoked, it may result in the loss of any pending Referral Award(s). In addition to the revocation of participation privileges, CyberFOX shall have the right to take appropriate administrative and/or legal action, including, but not limited to, seeking criminal prosecution, as it deems necessary in its sole discretion. Failure by CyberFOX to enforce any term of these Terms shall not constitute a waiver of that term or any other term herein.
  7. Governing Law and Dispute Resolution:
    1. Except where prohibited, you agree that any and all disputes, claims, and causes of action arising out of, or connected with, the Program or incentive provided shall be resolved on an individual basis, without resort to any form of class action, and exclusively by the appropriate court located in Hillsborough County, Florida. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Terms, your rights and obligations, or CyberFOX’s rights and obligations in connection with the Program shall be governed by, and construed in accordance with, the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules (whether of the State of Florida or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Florida.
  8. Release and Limitation of Liability:
    1. By participating in the Program, you agree to release and hold harmless CyberFOX, its subsidiaries and affiliates, and each of their respective officers, directors, employees, contractors, and agents (the “Released Parties”) from and against any and all liability, claim, demand, loss, cost, or cause of action arising out of your participation in the Program or your receipt or use/misuse of any incentive, including, but not limited to,
      1. Unauthorized human intervention in the Program
      2. Technical errors
      3. Errors in the administration of the Program.
    2. In no event shall the Released Parties be liable for attorney’s fees. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
  9. Privacy:
    1. You acknowledge and agree that CyberFOX will handle the details, including personal information, that you submit about yourself and each Referral under the Program in accordance with its existing Privacy Policy, which can be found at https://www.cyberfox.com/privacy-policy/.
